1. Acceptance of Terms

By accessing and using the Dog Pedigree Database (the "Service"), you accept and agree to be bound by the terms and provisions of this agreement. This Service is operated by Fusion Reactions ("we," "us," or "our").

This is a private system accessible only to authorized users by invitation. If you do not agree to these terms, you may not access or use the Service.

2. Development Phase Disclaimer

IMPORTANT: This Service is currently in active development. Features, functionality, and data may change without notice. While we strive for accuracy and reliability, the Service is provided on an "AS IS" and "AS AVAILABLE" basis during this development phase.

We make no warranties, expressed or implied, regarding the availability, accuracy, reliability, or functionality of the Service during development.

3. User Accounts and Access

Access to the Service is granted by invitation only. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring the accuracy of information you provide

We reserve the right to suspend or terminate accounts at our sole discretion, without prior notice.

4. Data Accuracy and User Responsibilities

Users are responsible for the accuracy of data they enter into the system, including:

• Dog pedigree information
• Registration numbers
• Competition results and titles
• Owner and kennel information

We are not responsible for verifying the accuracy of user-submitted data. Users agree to provide accurate, current, and complete information.

5. Privacy and Data Visibility

The Service implements privacy controls allowing users to designate their data as:

• Private: Visible only to the owner
• Kennel: Visible to kennel members
• Public: Visible to all users

Exception: Dogs with verified titles/awards may have their name and registration number displayed publicly regardless of privacy settings, as these are matters of public record.

Users are responsible for setting appropriate privacy levels for their data. See our Privacy Policy for details on how we handle your information.

6. User Conduct and Non-Disclosure

Users agree to:

• Use the Service only for lawful purposes
• Respect the privacy settings of other users
• Not scrape, harvest, or systematically extract data from the Service
• Not share, distribute, or republish data obtained from the Service without proper authorization
• Not use automated systems (bots, scrapers) to access the Service
• Maintain confidentiality of private and kennel-level data accessed through the Service

Users found in violation of these terms may be held liable for damages and will have their access immediately terminated.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Fusion Reactions and is protected by international copyright, trademark, and other intellectual property laws.

Users retain ownership of data they submit to the Service. By submitting data, you grant us a non-exclusive, worldwide license to use, store, and display that data as necessary to provide the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Fusion Reactions shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Fusion Reactions' total liability for any claim arising from use of the Service shall not exceed $100 USD
• We are not responsible for data loss, corruption, or inaccuracies in the database
• We are not liable for decisions made based on information in the Service
• Users are solely responsible for maintaining backups of their critical data

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. User Indemnification

You agree to indemnify, defend, and hold harmless Fusion Reactions, its officers, directors, employees, and agents from and including any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms of Service
• Your violation of any rights of another party
• Inaccurate or fraudulent data you submit
• Your breach of confidentiality or privacy obligations
• Any data breach or security incident caused by your actions or negligence

10. Dispute Resolution and Arbitration

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Arbitration Agreement: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration in Monroe County, New York, in accordance with the rules of the American Arbitration Association.

Court Venue: If arbitration is unavailable or unenforceable, any legal action must be brought exclusively in the courts of competent jurisdiction located in Monroe County, New York. You consent to the personal jurisdiction of such courts.

Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action or other representative action.

11. Data Retention and Deletion

We retain user data for as long as accounts remain active. Users may request deletion of their accounts and associated data by contacting us. Upon deletion:

• Personal account information will be permanently deleted
• Dog pedigree data may be retained in anonymized form to preserve genealogical records
• Public competition results and titles of public record may be retained

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Termination

We may terminate or suspend access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
